When applying for an ITIN, you will need to confirm your identity and foreign status by providing certain identification documents. The ITIN might be helpful in claiming state tax benefits and credits. Please review the IRS’s ITIN application instructions to determine if, or how, your dependents might qualify for an ITIN.

You would not have an ITIN unless you applied for one in the past. Below are some questions that people often ask about how to get an ITIN number. In both cases,  we must physically examine your original, valid passport. We must have your passport in our hands so we can certify that it is authentic. The IRS rules do not allow us to accept a certified copy of your passport. We cannot process your ITIN application without reviewing your passport. When you submit your application, you must include documents that demonstrate why you need an ITIN. Without the required documentation, the IRS will reject your application and you have to start over.

ITINs that have not been used on a tax return for Tax Year 2019, Tax Year 2020 or Tax Year 2021 will expire December 31, 2022. Unless you will not need to file an income tax return next year, you will likely need to renew your ITIN if you fit either of the above two categories. How to Apply for an ITIN

The ITIN is used in place of an SSN on a tax return to identify you, your spouse, or dependent without an SSN, on the tax return. An exemption to this requirement allows those with a SEVIS record to submit a letter from the HIO certifying the applicant’s identity. Unfortunately, some of the ITIN Operations Center adjudicators do not apply this exemption. The only solution for this is to reapply with the same materials and the HIO letter. J-1 students who are employed (e.g., GSI/GSR, other student workers) and J-1 scholars are NOT eligible for an ITIN and must apply for a SSN at a Social Security Administration office.

Tax treaties are only applicable to those who are nonresidents for tax purposes. If you must file a U.S. tax return or you are listed on a tax return as a spouse or a dependent and you do not have, and cannot obtain, a valid Social Security Number, you must apply for an ITIN. The IRS no longer accepts “SSA205c”, “applied for”, “NRA”, blanks, or previously issued IRS temporary numbers. Include your ITIN on the return to ensure prompt processing and receipt of any refund.

The protections against the disclosure of information are set in law so they cannot be rescinded by a presidential executive order or other administrative action unless Congress changes the law. Parents or guardians may complete and sign a Form W-7 for a dependent under age 18 if the dependent is unable to do so, and must check the parent or guardian’s box in the signature area of the application. Dependents age 18 and older and spouses must complete and sign their own Forms W-7. ISS will prepare ITIN support letters for you and have the original available to pick up once it is ready. Social Security Numbers (SSN) and ITINs

Many people who are not authorized to live in the United States worry that filing taxes increases their exposure to the government, fearing this could ultimately result in deportation. If you already have an ITIN, then the IRS has your information, unless you moved recently. You are not increasing your exposure by renewing an ITIN or filing taxes with an ITIN. This tax benefit is worth up to $2,000 for each child under 17, and up to $1,500 of the credit is refundable.
